What applies when you advertise on Lovele

These Advertiser Terms are an agreement between ANDIAMO SOFTWARE SRL, a company incorporated in Romania ("Lovele", "we", "us"), whose identification details are listed under Company information at the end of these terms, and the person who buys advertising on Lovele ("you"). They apply to every campaign you order and to every top up of your advertising balance, together with the Terms and conditions published at lovele.app/terms, which govern the Lovele account through which advertising is bought. Where the two documents cover the same matter, these Advertiser Terms apply to advertising. Questions about advertising are answered at ads@lovele.app.

Lovele is a social media platform monetized through digital advertising. You buy advertising services from us: placements and promotional campaigns displayed within the Lovele platform, in the following formats: Paid Views, in which a member of Lovele opens the page you advertise, within Lovele or in a new tab, and keeps it open for the number of seconds you choose; banner ads, images in the standard sizes offered in the order form, displayed in the feed, beside it and on other pages of Lovele; video ads, short videos displayed within Lovele, which may end with a button to your site; and sponsored posts, posts that carry your name and the Sponsored label, with an image or a short video and a button to your site, displayed in the feed between other posts. The formats, sizes, placements and targeting options available at any time are those shown in the order form. Lovele is the merchant of record for these services and the only party you pay. No part of your payment is paid, transferred or owed to any user of Lovele, and you make no payment to users. Lovele also operates a rewards and referral programme for its users, funded from the overall revenues of the platform; that programme is not part of this agreement and gives you no rights and no obligations.

You may buy advertising only as a business acting in the course of its trade, or as an individual who is at least 18 years old and has full legal capacity. You must give accurate billing details and keep them up to date. We may ask you at any time to verify your identity, the identity of your business, or your right to promote the product, service or site you advertise, and we may pause your campaigns until you do.

A campaign, including every text, image and video in it, the page it links to, and anything that page leads to must not: promote money games or any activity in which money or anything of value is staked on an uncertain outcome; contain or link to sexual content or nudity; offer loans, short term credit or other consumer credit; offer token sales, coin offerings or airdrops; promote alcohol, tobacco, vaping products or electronic cigarettes; promote dating, matchmaking or companionship services; promote weight loss products, diet pills or cosmetic surgery; promote trading in shares, foreign exchange, contracts for difference, binary options or crypto assets, or any other form of financial speculation; promote schemes that promise quick or certain income, including multi level marketing and pyramid schemes; promote weapons, ammunition or explosives; promote recreational drugs, drug paraphernalia or prescription medicines; make claims about health, medical treatment or cures; install, or prompt the installation of, software the visitor did not ask for; be aimed at persons under 18; be unlawful in Romania or in any country the campaign targets; be false, misleading or deceptive, including about who you are, what you offer or its price; contain or distribute malware; or attempt to obtain passwords, payment details or other personal data by deception.

Every campaign, in every format, is reviewed by a person before it can be shown, together with its texts, images and videos. Images and videos you upload are also checked automatically before review; an upload that matches known child sexual abuse material is preserved as evidence and reported, and your account is suspended. We may refuse a campaign, and we may pause or end a running campaign, where it breaks section 4 or these terms, where the page it links to changes after approval, where we receive credible reports about it, or where the law requires us to. A campaign refused at review is not charged, and its budget returns to your advertising balance. Where we pause or end a running campaign, the views and impressions already delivered remain charged, and the budget not yet used is treated as unspent balance under section 8.

Advertising is paid in advance from an advertising balance kept in United States dollars. You top up the balance in crypto assets through NOWPayments, the payment processor: you choose one of the crypto assets offered in the top up form, and the payment processor issues an invoice in United States dollars, converts the amount due into that asset at its own rate and handles the payment on its own page; we never receive the keys or the credentials of the wallet you pay from. Where we agree to it in writing, a top up may also be made by bank transfer against our invoice. The balance increases only when the payment processor confirms to us that the invoice has been paid in full. Network fees charged for sending a payment are borne by you. The price of a campaign is the one shown in the order summary before you confirm it, and it does not change for that campaign; views or impressions you add to a campaign later are charged at that same price. The advertising balance is not a deposit, bears no interest, cannot be transferred, and can be used only to buy advertising on Lovele.

You pay only for validated delivery, counted for each format as follows. For Paid Views, a validated view: the member kept your page open for the number of seconds you bought, completed the check at the end of the view, and was not rejected by our fraud controls. For banner ads and sponsored posts, a validated impression: at least half of the ad stayed visible on the member's screen for at least one second, within our frequency limits, and the impression was not rejected by our fraud controls. For video ads, a completed view: the video played for its full length, with at least 90 percent of it shown, and the view was not rejected by our fraud controls; a video ad skipped before its end is not charged. Views and impressions identified as invalid traffic, including automated, repeated or suspected fraudulent ones, are not charged, and the budget they would have used stays with the campaign. We do not promise any number of views, impressions, clicks, sales or other results, or that a campaign will run at a particular time or speed.

Budget spent on validated views, validated impressions and completed views is not refundable. Unspent balance may be refunded on a request sent to ads@lovele.app within 30 days of the top up it comes from, less the fees charged by the payment processor and by the network for that payment and for the refund. Each request is assessed individually. A refund of a crypto top up is paid in crypto assets, in an asset and on a network we agree with you, to a wallet address that you provide and control, for its amount in United States dollars converted at the rate applied when the refund is sent; a top up made by bank transfer is refunded to the account it came from. A refund sent to the address you gave us settles our obligation, and we cannot recover crypto assets sent to an address you gave us in error. Budget allocated to a campaign that is still running is not unspent balance.

A crypto payment confirmed by the payment processor is final, and we do not reverse it except through a refund under section 8. An invoice that is not paid in full before it expires is closed without topping up your balance. An amount that arrives short, late or in another asset is credited to your balance or returned to you, as agreed with you through ads@lovele.app, less the fees charged by the payment processor and by the network; we may be unable to recover crypto assets sent to a wrong address or on a wrong network. If a payment that topped up your balance is later reversed, recalled or withheld, by the payment processor or by a bank, we may pause your campaigns and refuse new ones until the matter is resolved. Where the reversal was not justified, you remain liable for the advertising delivered and for the costs it caused us.

You are responsible for your campaigns, for the site they link to, for the products and services offered there, and for every claim made about them. You confirm that you hold the rights needed to use every text, image, sound and trademark in your campaigns. You will indemnify us against claims by third parties arising from your campaigns or from your site, to the extent permitted by law.

Except where the law does not allow it to be limited, our total liability to you under these terms is limited to the amount you paid for advertising in the twelve months before the event giving rise to the claim, and we are not liable for loss of profit, revenue, data or business opportunity. Nothing in these terms limits liability for intentional fault or gross negligence, or affects the rights you have as a consumer where you buy advertising as a consumer.

We may amend these terms. The amended version is published on this page with a new date, applies to campaigns ordered and top ups made after that date, and you are asked to accept it before your next order or top up. You may stop advertising at any time; unspent balance is then handled under section 8. These terms are governed by Romanian law. Disputes are subject to the jurisdiction of the competent courts of Bucharest, Romania. Where you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your habitual residence or of your right to bring proceedings in the courts of your domicile.
